Terms of Service

TOP Posters is an image transformation API that generates enhanced movie and TV artwork — posters with ratings, badges, and overlays — based on third-party metadata identifiers (e.g., TMDb, TVDB).

The Service is provided on an "as is" and "as available" basis and may be modified, updated, or discontinued at any time.

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent that you meet both requirements.

To use the Service, you may be required to obtain an API key. You agree to:

• Keep your API credentials secure and confidential
• Not share your API key publicly or with unauthorized parties
• Be fully responsible for all activity under your account

We reserve the right to suspend or revoke API access in case of misuse, abuse, or violation of these Terms.

Access to the Service may require payment. By subscribing or purchasing access, you agree that:

• Fees are billed as described at the time of purchase
• Payments are non-refundable unless otherwise stated
• We may change pricing at any time with reasonable notice

Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (quarterly or annual) via Stripe. You will be charged the applicable fee at renewal unless you cancel before the renewal date. You can cancel at any time from your dashboard.

Failure to pay may result in suspension or termination of access.

We may offer a 7-day free trial for paid plans. The following conditions apply:

• Each account is eligible for one free trial only
• A valid payment method is required to start the trial
• If you do not cancel before the trial ends, your subscription will automatically convert to the selected paid plan and you will be charged accordingly
• We reserve the right to modify or discontinue the free trial offer at any time

You agree not to:

• Use the Service for any unlawful purpose
• Abuse, overload, or excessively query the API
• Attempt to reverse engineer, replicate, or copy the Service
• Resell, sublicense, or redistribute the Service without permission
• Use the Service in a way that violates third-party rights

We reserve the right to enforce rate limits and block abusive traffic.

The Service uses and processes images sourced from third-party platforms, including TMDb, TVDB, and fanart.tv. These images are not owned by TOP Posters and remain subject to the copyright and licensing terms of their respective owners.

TOP Posters does not claim ownership of third-party artwork, does not grant any license to use such images beyond what is permitted by their original sources, and provides only transformation and enhancement of existing content.

If you integrate the Service into a third-party application, you are solely responsible for how generated images are used, displayed, cached, or distributed, and for ensuring compliance with all applicable laws and third-party terms.

TOP Posters is not responsible for any use of the Service within third-party applications.

All rights, title, and interest in and to the Service (excluding third-party content) remain the exclusive property of TOP Posters, including API design and functionality, processing logic, and branding.

You may not copy, reproduce, or create derivative services based on the Service.

Certain third-party providers (such as TMDb) may require attribution. You are responsible for providing proper attribution where required.

We do not guarantee uninterrupted or error-free operation of the Service. The Service may experience downtime due to maintenance, updates, or unforeseen issues.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee:

• Accuracy or completeness of data
• Availability or uptime
• That the Service will meet your requirements
• That generated content is free from legal restrictions

To the maximum extent permitted by law, TOP Posters shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of profits
• Loss of data
• Business interruption

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms.

You may stop using the Service at any time.

We may update or modify the Service and these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and interpreted in accordance with the laws of Italy. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of TOP Posters to be effective.
